1. Introduction

Welcome to QA Audit and Alternate QA Academy ("we," "our," or "us"). By accessing or using our website, academy, simulations, and services, you agree to be bound by these Terms of Service.

2. Nature of Services (AI Disclaimer)

Our services utilize Artificial Intelligence (AI) to analyze data and generate recommendations. You acknowledge that:

  • AI Output Accuracy: AI-generated content may contain errors, inaccuracies, or biases. It should not be relied upon as the sole source of truth for critical decisions.
  • Professional Judgment: The output is intended to assist, not replace, professional QA judgment. You utilize the recommendations at your own risk.

3. Educational Platform (Academy)

This platform includes a simulated environment designed for training purposes.

  • Educational Purpose: All tools, bugs, and scenarios presented in the simulator are fictional. Any resemblance to real-world vulnerabilities is coincidental.
  • User Conduct: You agree to use the platform responsibly. Attempting to compromise the platform infrastructure itself is prohibited.

4. Client-Side Tools (Chaos & Data)

Specific tools like the Chaos Engineering Assistant and Synthetic Data Factory are provided as client-side utilities.

  • Privacy: We do not store, process, or transmit any data entered into these specific tools. All generation happens locally in your browser.
  • Liability: You are responsible for how you use generated "nasty" data or chaos scenarios. We are not liable for any misuse.

5. User Content & Data

You retain all ownership rights to the data you input into the audit ("User Content").

  • License: You grant us a limited license to process your User Content solely for the purpose of generating the audit report and recommendations.
  • Confidentiality: We do not sell your data. We use industry-standard security measures to protect your information.

6. AI Credits & Fair Use

Unless you connect your own third-party API key (see Section 11), AI-powered features draw on an account-wide credit balance rather than being unlimited:

  • Free plan: a fixed number of credits granted once, for the lifetime of the account. These do not renew.
  • Pro and Team plans: a number of credits granted each billing period. Unused credits carry over by at most one additional period; any further unused balance is forfeited at renewal.
  • Credit packs: Pro and Team accounts may purchase additional credits as a one-time, non-subscription purchase. Purchased credits do not expire and are not affected by the monthly carry-over limit above.
  • System availability: We reserve the right to temporarily suspend, throttle, or fail open on credit enforcement during technical incidents affecting our systems. A period during which usage was not correctly limited due to such an incident does not obligate us to provide equivalent unmetered access going forward.
  • Changes to credit allotments or pricing: We may adjust how many credits a plan includes, the credit cost of a given feature, or credit pack pricing at any time; we will make reasonable efforts to communicate material reductions in advance.

7. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

8. Intellectual Property Rights

The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of Alternate QA and its licensors.

  • Copyright: The source code, algorithms, visual design, and content of this application are protected by copyright, trademark, and other laws of both the Country and foreign countries.
  • No Copying: You generally agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service, use of the Service, or access to the Service without express written permission by us.

9. Prohibited Activities

You agree not to engage in any of the following prohibited activities:

  • Reverse Engineering: Decompiling, reverse engineering, or attempting to derive the source code of the Service.
  • Scraping: Using any automated system, including without limitation "robots," "spiders," or "offline readers," to access the Service.
  • Harmful Acts: Uploading viruses or malicious code, or interfering with the integrity or performance of the Service.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES.

11. API Keys & Financial Responsibility

Our platform allows you to connect your own third-party AI API keys (including but not limited to Google Gemini, OpenAI, and Anthropic) to power AI-driven features such as the AI QA Coach, QA Audits, Test Strategy Generation, Academy evaluations, and other AI-powered tools.

  • Key Storage: Your API keys are stored exclusively in your browser's Local Storage and are never transmitted to, stored on, or accessible by our servers.
  • Financial Responsibility: All costs incurred through your API key — including but not limited to AI Coach conversations, QA Audits, Site Audits, Test Strategy generation, Career Roadmap generation, Competency Analysis, Prompt optimization, Academy task evaluations, Course Constructor generation, and any other AI-powered feature — are your sole financial responsibility.
  • No Liability for Third-Party Charges: Alternate QA is not responsible for unexpected charges, rate limits, billing errors, or any other financial issues arising from the use of your API key with third-party AI providers.
  • Spending Limits: We strongly recommend that you set monthly spending limits in your AI provider's dashboard (Google AI Studio, OpenAI Platform, Anthropic Console) to prevent unexpected charges.
